Slip & Fall (Premises Liability)

A slip and fall accident occurs on a property when a business or property owner’s negligence in maintaining a safe condition causes injury to a visitor.  Proving a slip and fall claim is unfortunately made more difficult because the proprietor of the business is allowed to show that it has a system in place for timely inspections of the conditions of the floors of its premises.  Regardless, if and when the proprietor of a business knows or should have known of a defective or dangerous condition, the proprietor has a duty to its patrons to discover and correct the defective or dangerous condition.  If the proprietor fails to do so, resulting in a slip and fall which causes objective injury to a patron, the proprietor is responsible to pay for the damages in a sufficient amount to make the injured patron whole or in the same position they were prior to the slip and fall.
